There are many circumstances in which FCC rule violations are unavoidable,
accidental, or even warranted under special circumstances - primarily
emergencies and imminent threat to life or property. Exceptional
circumstances occur all the time. The way to handle it is this...
- Document what happened and what rule was violated.
- If it was accidental or the result of equipment failure, explain how you
plan to rectify the problem and prevent future recurrences.
- If it was caused by physical circumstances beyond your control, explain
that and document them.
- If it was an operator problem, explain what steps you will take to insure
that it doesn't happen again.
- If the violation occurred as a consequence of responding to what you
perceived as an emergency situation or other extreme circumstances, explain
that.
You demonstrate that you understand and respect the rules and are taking
appropriate steps to operate within them. Problem solved.
The FCC is not looking to bust stations that operate to the best of their
ability and in the public interest. Your documentation will be filed and
that will be that. As long as you don't make a habit of violating the rules
or give flimsy excuses for doing so, there is not going to be an issue.
