I seriously doubt it.

The antenna was there first AND that was declared a "radio Free Zone" 
back then.  Any one building within that zone is bound by law not to 
cause interference.
As Jim and others have said, when built Green Bank was "out in the 
boonies" and too bad the developers weren't required to tell people you 
can cause interference or even have a transmitting device in this area.
To me it's more akin to building an airport out in the boonies and then 
having people build next door and complain about the noise. Or OTOH put 
up both receiving and transmitting antennas too close.

I was on final for 36 in a plane that weighs nearly two tons. Something 
caught my attention, but I couldn't make it out clearly. Towers are very 
difficult to see, particularly when they aren't painted AND you are 
moving 100 MPH plus. Guy wires are invisible.  About 1500 feet off the 
end of the runway was a guy installing a TV antenna on top of a 70-90' 
tower.  On a 3 degree glide slope, that would put me at roughly 78'. I 
had to take evasive action and I'd guess I missed him by maybe 10-15 
feet with the gear. Next day the tower was gone.  Of course that's when 
the complaints started and there was a push to "close that noisy 
airport"  When the city had to explain any land purchased with 
government grants would have to be paid back _at-current_value_, not the 
original grant the voices got a lot weaker.  Most grants have a 20 year 
life, but for land it's forever.

Green Bank, OTOH had it written right into the regulations that a 
relatively large area was to be radio free.

However, having said all that, eventually it will reach a point where 
they just won't be able to maintain a silent area, and the population 
will become so great the site will eventually be closed down due to 
political pressure, not lawsuits as they have the power of law on their 
side.
