Just because they're amidst a profession, doesn't mean they're without
grasp of others. Remember that it doesn't take college degrees, higher
education, or state board exams to become a HAM operator... and that some
of the sharpest HAM operators are not only members of the BAR, they're also
found performing open-heart surgery, teaching grade-school music, looking
for gas giants, and monitoring plate techtonic drift rates. Alas, there
are a substantial number of Barristers who DO have technical background...
and Riley is a prime example. Many of them practice patent-law, but others
prosecute and defend liability and workman's comp cases. They don't
necessarily know ALL the law, but must know the rules of procedure, know
how to do research, but they must also be investigators, be astute
observers, and able to keep nerve and focus when working solely on a
gut-feeling. When the subject is beyond their understanding, they call in
professionals, but they sure don't wash their hands of their case's
details. They're also more-or-less 'professionally obligated' to argue the
case in their client's behalf, REGARDLESS of wether they agree with the
position.
You may not have had the benefit of my 11th grade American Federal
Government class, but if you look it up, you'll find that the FCC falls
under the Executive Branch of the Federal Government, and the Commissioners
(like appointees in other regulatory positions) are appointed for defined
terms by the President. The President has no obligation to make
appointments based on any defined criteria- there's no 'entrance exam'
required, no resume review, no years-of-experience or GED requirement...
just a simple background check and a bunch of duck-quacking for the
Legislature to grant it's approval of the appointment. If you have ANY
fingers to point, start by looking at resumes, and see who at The
Commission has the technical background to make educated decisions. THEN
look up the year in which they were appointed, and the criteria by which
they were selected, and the legislators who 'gave blessing' to those
appointments. I wouldn't be the least bit suprised if appointments occured
largely as a result of 'favored interests', but it's a cryin' shame when
the 'favored interests' yield regulatory motivations which are in direct
contradiction with Laws of Nature.
Keep in mind that there is no physics property which maintains any
relationship between power, intelligence, or competence... all combinations
occur naturally can occur, but it's most often that the WORST combinations
go most noticed.
