Gee -- I certainly hope that a Rule or Regulation based entirely on 
enhancing the safety of aviation is not considered excessive!

A suggestion. If you haven't already done so, it would be worth running 
HFTA on your location to get a good assessment of your NEED for a 160 ft 
tower, and how MUCH you would benefit from it.  Some of us need them and 
some don't.
