I would like to point out a few FACTs regarding this current foul up and
perhaps make a suggestion or two. I do regard this as contest related
as I think an individuals's call is of utmost importance.

For those of you who aren't aware, for the past year and a half, I have
operated Shadow Software Inc, which provided printouts and disk of the
vanity calls. I also performed a hand delivery service and was in fact,
in Pittsburgh on Friday night, September 19 at the Mellon Bank waiting
for the date stamp to increment to the 23rd at midnight. Before you touch
the ignitor to the flamethrower, Shadow is CLOSED!! Out of business! Kaput!

But over that time period, I was frequently in touch with the FCC and the
Mellon Bank. What I relay here is fact, not rumor, and I or you can verify
every single statement. And I am intimately familiar with the databases.
( and if N3SI is reading this or you know him, please ask him to ask the
FCC to correct his call in the database. It has been NN3SI for several
months )

Starting at the beginning, we all remember the FCC putting out those 
notices saying the OMB was responsible for the delay in getting the actual
610V form approved. Well, I spoke to the individual in the OMB who in
fact handled it, and he told me it was done in 22 days. He also added that
it had probably sat in his incoming mail file for 21 of those days. 

So let's start off at the beginning by saying the FCC has consistently
lied and misled.

We all know abuses have taken place in Gate 1 and 1A. Proving them or
getting the FCC to take action is entirely another matter. In so much as
the FCC ITSELF also committed abuses during the same time period, I rather
doubt any substantive corrections will take place, but if you want to see
a rather blatent one, download INDIV.ZIP and take a look at W7MT. He,
applied for a call sign change from W7MT to K7AFS ( I think that's correct )
This transaction occured on 6/4/96. ON 6/4/96, the EXACT SAME DAY, W7MT was
issued to a N7x3. (sorry, I just don't have the letter I wrote to the FCC
handy with the exact calls. ) The last time I checked the database, there
were 2 other instances where calls were relinguished and immediately 
reassigned, both 4s ( 1x3s if I remember correctly )

Upon the initial news the FCC was planning the WEB page, I did call and
talk to the individual who was setting it up. It initially would have
REQUIRED a credit card and REQUIRED a box being checked WAIVING any 
responsibility if the CC was misused, intercepted, ect. I wrote them a
very straightforward letter, the essense being that their proposal
violated so many Federal Laws that if they attemped to implement it, I
would ask for an emergency injunction in court. ( for instance, for any
of you who might have filed and used your CC number, please be aware that
anyone!!! can write the FCC, and get a complete copy of your application,
PLUS your CC number.( Freedom of Information Act of 1974, as amended )
The OMB was also very interested in that fact....seems the FCC had forgoten
to request approval. All of you know the issue all of a sudden went very
quiet, to be resurected only 2 days before the Mellon would actually start
accepting applications. Little too late for court action as I was sitting
in Pitt then.

As for my trip there, the Mellon was set up and ready to go. They DID
accept the 610Vs in the order they were handed over, they DID put them in
letter trays in THAT order, and the manager of the Lockbox Office ( not the
Supervisor, the MANAGER ) told me earlier in the day that they would process
them IN THAT ORDER, and forward them to the FCC IN THAT ORDER. At this 
point, it would have been merely a matter of the FCC taking the top
application, asking the computer if the #1 call was available, and if so,
issued it. It would have been a matter of at most 2 days. Instead we are
all stuck with the mess they've made of it. They got about 337...or so
by the WEB and over 4000 by Mellon. Talk about the tail wagging the dog.

So, at this point, the FCC has positioned themselves to be the SOLE
entity who decides who comes first. ( and I understand that either K2KW
or W2KW HAS been issued, at the request of the ARRL, who wants to do a
cover story on that individual. It does NOT show in the database,)

Horror stories can go on and on. I'm through fighting..I didn't request
a call sign change... 

BUT, do we take it laying down?, or is their some large club out there whose
members feel strongly enough about this to to engage the services of an
attorney and stop this mess right now! The FCC changed the rules. After
they start processing, it will be simply too much of an administrative
nightmare to undo. ( not to mention the howl which the new W6DX or W5DX
will put forth ) And if you for one minute think there aren't a bunch of
calls which have already been set aside for various people, you probably
own a bunch of swamp land. The FCC DID remove W5DX from the list of
available calls, but when confronted directly with that fact, put it back
in. stating "opps, just an administrative error...."

I don't know what else they have done, and at this point, I simply don't
care. 

Do we, as a group, feel strongly enough about this matter to file a court
action simply asking that the FCC be required to do what they themselves
stated they would?, which will effectively stop the Vanity program, or do we 
roll over on our backs? If it's going to be done, it must be now.

There are surely going to be replies...Please, address them to the group.
This is important to a lot of people...maybe others are simply not
interested...I don't read editorial pages in the paper....that's my
choice...you don't have to read this.

And for those of you who wonder why I feel so strongly about this, it's
not the vanity part. No one of you is above the law, and neither is the
FCC, but they have broken it, deliberately, and in doing so, have corrupted
our hobby and I have loved that for too long.

Hi Ed,

I'm as annoyed as anyone else of the changes in rules AFTER the fact 
but at this point I'm just in a waiting mode to get whatever comes 
through. To stop the whole thing now would surely make for lots of 
unhappy people. It would have been nice if some of these things were 
acted on by the ARRL in the beginning but there is a slow moving 
process and lack of backbone in speaking up there. The ARRL knew that 
there would be electronic filing. One Director said on here NO WAY 
and then maybe from later info from the ARRL VEC people who were 
pretty sure it would happen. They were aware of it on Thursday I 
think and told anyone who called.

I don't know of the K2KW/W2KW situation other than to say Clarence 
W2KW is a good friend and about now should just be setting up shop in 
the Virgin Islands as he does every year. I don't speak to him until 
he gets there each year. Clarence is old any I could miss news of his 
health. I do know that when he passes his nephew Dan Zarinski, WA2EYB,
 is expected to claim his callsign at Clarence's orders. Dan is 
almost totally inactivy the last 15 years or so but has been told he 
will keep the call active. Clarence's station at Middletown, NY is 
known as Radio Hill North and has been a real example of wire 
antennas of major effort. The place has been toured by many groups 
over the years.

Subject: Kenwood - The FACTS

Gentlemen,
        I know many of you are tired of and/or not interested in this
thread, however, there seem to be many newcomers who are not aware of the
FACTS concerning Kenwood's new marketing strategies. Since I believe
everyone is entitled to the facts before making judgements, here they are:

1. Kenwood DID publicly announce the opening of new distribution channels
through CB and truckstop distributors.
2. Kenwood, via Paul Middleton, DID acknowlege the above in their written
response to a flood of protesting mail and email. Unfortunately, I trashed
the letter in disgust after reading it, so I no longer have the evidence, but
   I'm sure others still do.

        Now, it seems, they may be changing their plans, or just changing
their tactics to out and out lying about it. I certainly hope it is the
first. If that is the case, and Kenwood has rethought their plans, I would
like to see a public announcement stating the same. Otherwise, I would
advise taking anything said by other means (such as personal LL calls) with
the proverbial grain of salt. Until such public statement mentioned above,
I, for one, will not consider buying a Kenwood product.
