Oh well, it was pretty utopian. A ham I know fought a long legal battle
against a neighbor who claimed the setback should be the total of the
tower height plus half the longest horizontal element of the antenna on
it. The ham won, but it wasn't easy.

From a regulatory standpoint the latter isn't really workable. The
adjacent property owner could build a new structure (barring setbacks,
etc.) that's closer to the boundary, after the tower is up.
