My biggest problems with HOAs
1)When HOAs expand - there have benn cases where HOAs have 'annexed' land where
there WAS no HOA to begin with, and in some states, it's been ruled that being
that more than 50% voted for it, you now MUST join the HOA and follow the rules
2)And then combine that with the fact that HOAs have been ruled NOT to be a
government (then how can they annex you and force you to join - see 1), and
therefore are NOT subject to the same rules/laws that restrict governments
Let's face it, HOAs ARE, defacto, but not DeJure, local governments, and really
SHOULD be classified that way - they collect taxes (dues), they enforce 'laws'
(their rules and regulations), they provide, in many cases public services
(many arrange for garbage pickup etc)
Let's call them what they are - the local Govt, and lets TREAT them that way
