have been hired and then gotten injured, and it was harder on the  illegal 
than the employer.  The employer just fires them and there is  not much the 
illegal can do as they are not supposed to be here and can't  complain. 
Unfortunately, in Oregon you can't ask them for their  identification, or 
check if they are legal or not.  We need to get a  handle on the illegal

In California it is NOT harder on the immigrant. It is harder on the  
employer.
The immigrant does not have to prove that he/she is here legally,  only that
the person was injured on the job. My daughter is a workers comp  applicant
attorney (she works for the person who claims to be injured). I  hear these 
stories all the time. Firing does not abrogate the responsibility from the 
employer. 
 
Being illegal is a totally different story. It doesn't matter in  California.

My concern is to attempt to protect any potential employer  from an easy 
lawsuit.
Manual labor is notorious for injuries which may be  difficult to prove that
(1) the injury is not a result of employment and (2)  an injury actually 
occurred.
