You are correct about modulated CW in the sense of a carrier modulated by 
an audio tone.

However, there would be nothing illegal about sending CW from a sound card, 
provided it was a single tone fed into the mike input of an SSB 
transmitter. The output would be a single RF frequency and would be 
indistinguishable at the receiver end from a "normal" CW transmission.

Whether this is a good idea or not is another matter. 8-)
