John,
You're unlikely to find a distributor within the U.S. I don't believe that
most (perhaps all) of Tokyo Hy-Power's HF product line complies with the
terms of FCC Type-Acceptance. Some of their HF amps will accept less than
50-watts in order to achieve their target output power - something not
allowed by 47 CFR 97.317 which thanks to the CB revolution, became effective
in 1978.
The amps you're seeing in the U.S. (and on eHam) are being purchased
"factory-direct" from JA - despite the fact that 47 CFR 2.803 dictates that
no marketing, nor sales of a device that is subject to certification shall
be allowed in the U.S. until it meets certification. An exemption exists in
instances where a forthcoming product is being used in trade shows,
exhibits, and demonstrations but a prominent, visible disclaimer is required
at such events.
What's not immediately clear within the rules is the extent to which the
purchaser is culpable when s/he purchases the non-certified amplifier for
amateur use. In the past, the FCC has pretty much placed the onus for
compliance with the manufacturers and not on the end users in this
"dealer-to-junkie" relationship.
