It may be a bit more complicated than that.  I recall reading of one bust. 
When the FCC knocked on the door, they still had a vehicle and field 
strength monitor outisde.  They knocked on the door and entered the shack, 
asking the ham to use his rig.  Then, they received a message from the FCC 
employee still in the car that the field strength was substantially less 
than before.  The inspector looked around and found a power switch under the 
console.  He flipped positions and voila, the field strength jumped to the 
previous reading.  Then then took measurements (that was in the power input 
days) and began the citation process.
