I know this contester who seems to show up in the WPX contest every year
with a different call sign. This person has a distinctive sounding voice so
I knew who he was. Anyway, I run into him in the WPX SSB contest this
weekend and ask him about the call sign. It seems that he borrowed it from
someone he met (over the air??) and this person gave him permission
to use it in the contest. Is this legal ??
Maybe I?m wrong ?but It appears from looking at the FCC rules that if you
are going to use a call sign the licensee needs to be present and you have
to abide by the privileges that
they have. Back in the 1990?s we used my call sign in WPX SSB from K8CC?s
station, but that was legal because I was present. I also think it would be
legal to use a club call sign if you are given permission by the trustee. I
looked up this call sign he used on QRZ.com and it is licensed to an
individual not a club.
§97.7 Control operation required.
When transmitting, each amateur station must have a control operator. The
control operator must be a person:
(a) For whom an amateur operator/primary station license grant appears on
the ULS consolidated licensee database
97.103 Station licensee responsibilities.
(a) The station licensee is responsible for the proper operation of the
station in accordance with the FCC Rules. When the control operator is a
different amateur operator than the station licensee, both persons are
equally responsible for proper operation of the station.
(b) The station licensee must designate the station control operator. The
FCC will presume that the station licensee is also the control operator,
unless documentation to the contrary is in the station records.
§97.109 Station control.
(a) Each amateur station must have at least one control point.
(b) When a station is being locally controlled, the control operator must be
at the control point. Any station may be locally controlled.
If the FCC regulations were not followed I think this would also be grounds
for disqualification in the contest
XIII. Disqualification: Violation of amateur radio regulations in the
country of the contestant, or the rules of the contest; unsportsmanlike
conduct; taking credit for excessive unverifiable QSOs or unverifiable
multipliers will be deemed sufficient cause for disqualification.
Incorrectly logged calls will be counted as unverifiable contacts.
