It is not the job of the Realtor to comment on or interpret in any way any
deed restrictions on property. A Realtor is NOT an Attorney and is
prohibited by law from offering any opinions on such documents. The Realtor
should be happy to assist his client in the normal course of business which
does include help in locating the required documentation at the Clients
request.... but Realtor involvement ends there. You need to hire your own
Attorney to assist in the legal interpretations of any documentation for
which you have concern as you would hire your own personal property
inspectors, CPA's etc.
As far as educating your Realtor...if you feel you need to do that...fire
him immediately....find an experienced Realtor with credentials. I suggest
searching for a CRS (Certified Residential Specialist) in your area..Less
than 4% of all Realtors nationwide hold the designation and even better if
you can find a CRB (Certified Residential Broker) (less than 2% of Realtors
have this)...finding one of these credentialed Professionals in your area
would be an excellent choice. If you can find a Realtor with either/both
designations you are dealing with an experienced and well educated
Professional.
