In 2003, CA AB-1228 basically added PRB-1 wording to the CA Gov't Code.
Approved by state legislature (both houses) and signed by Gov. Davis.
It is now found in section 65850.3 of the CA state code.

65850.3.  Any ordinance adopted by the legislative body of a city or
county that regulates amateur radio station antenna structures shall
allow those structures to be erected at heights and dimensions
sufficient to accommodate amateur radio service communications, shall
not preclude amateur radio service communications, shall reasonably
accommodate amateur radio service communications, and shall constitute
the minimum practicable regulation to accomplish the city's or county's
legitimate purpose.

   It is the intent of the Legislature in adding this section to the
Government Code, to codify in state law the provisions of Section 97.15
of Title 47 of the Code of Federal Regulations, which expresses the
Federal Communications Commission's limited preemption of local
regulations governing amateur radio station facilities.

With this said, however, there are many areas in CA that still make it
near impossible to put up any type of antenna or severly limits heights.
You'll need to check with your city/county see what's required to put up
the 40ft crank-up (such as building permits, variances, etc).  Also,
make sure you're not in an area covered by any type of HOA or CC&R that
restricts antenna support structures.  I just found out that the city I
live in in SoCal has HAM friendly code...upto 35ft with no building
permit required...and this in a small suburb near downtown L.A.!  Now I
need to get the tower up before someone notices and makes changes to the
books <g>.
