There are a number of "reasonable accommodation" laws which probably
what was used here. I'm not sure if 45' falls under "reasonable
accommodation" but its sure worth a shot. There is also the unwritten
"rule of incrementalism". Get a modest 20-25' tower up and then inch
it up to 30'. A couple of years later 35' until you reach your
desired height or hit a hard spot with the HOA.
There are a few LPDA's for V/UHF out there. Cushcraft used to have
one. KMA has a couple, I'll have to go through my links page
