It really is not that simple.  I own "old construction" and my house is in 
pretty constant need of maintenance.  Some people want a new home and in some 
areas, all of those come with CC&Rs.  In some areas, you can find a 
covenent-free home if you are willing to commute 1.5 hours to get into the 
places where the jobs are.  "You agreed to it" is really an oversimplification 
of issues a lot more complex than that.

You do have 2 choices -
1)Old construction or
2)Don't live there
