Yup, and I suspect ARRL expected that answer.  However, before they could
reasonably go to someone in Congress and seek introduction of similar
pre-emption legislation for amateur antennas, they needed to be able to
show they had exhausted their administrative remedies.  It's just an added
bonus that the FCC handed them such a dumb response -- makes great lobbying
ammunition.
