The doc doesn't say anything about patents. One device label says it is 
patented and the other said patent pending (I forget which said what). I 
bought mine in the early 1990's.

From the pictures I've seen, it seems that almost any metal fabrication
 
 
shop could crank them out. Maybe not for the same price, but it sure
doesn't look like it would be hard to make them.
