I think there is a much greater risk of getting a K3NM-type letter for 
transmitting split-frequency on an occupied frequency where the DX station 
can't hear those who had been using the frequency, than there is a risk of a 
getting a letter for transmitting SSB below 1840 or so.  

I suspect the Texas SSB ragchewers got their notices because there was ample 
space for them higher in the band, but they chose to use the CW/DX window 
anyway.
