I think this is what one can classify as a "Catch-22."

It's like the police officer who stops you for a routine minor traffic
violation (like a dark tail bulb in your tail light) and asks to look into
your trunk.  You have (in the US) the constitutional right to decline.  But
if you decline, you must be hiding something... so your car gets impounded
until they get a search warrant, on the grounds that you declined, so what
are you hiding?
