Then they will probably say the interference is real, but the
amateur service is not "critical".  Or they're say, go ahead and
sue, and if you win, the monetary damages will be zero (or the
proverbial one dollar), because ham radio is not a business, ham
radio licenses are free, thus there is no "economic loss."  
Of course if a ham interferes with BPL, there is a readily identifiable
loss of $29.95 per month, or whatever the rate is.
