It's real regulation.  The RTTY and Data allocation changed on Dec 15,
2006 when the voice allocations were expanded.

For USA stations, RTTY IS NOT PERMITTED ABOVE 3.6 MHz.  See the FCC regulations 97.305(c).  Note that 80m is defined as 3.50 to 3.60
MHz in
97.301  (they didn't make it easy to read).

The ARRL website has the latest regulations dated Feb 20, 2007.  There are other websites that have copies over 10 years old - make
sure you are reading the current rules.
