Hi Stu,

The zoning officer in my town sent me a letter yesterday along with the
pertinent ordinance telling me to remove my antennas (because of a
neighbor's complaint) because they were more than fifteen feet above
the roof which my R-5 sitting on top of my TA-33 on a roof tower
clearly is.  At the very least I was prepared to remove the
R-5...definitely not the beam! If anything, with the R-5 off.... I had
room to RAISE the beam.

Then, I downloaded the FCC's PRB-1 ruling from the ARRL's web site and
personally handed it to the zoning officer the next day saying ..."My
attorneys gave this to me to give to you and I believe that this FCC
ruling superceeds the township ordinance."  She doubted it and said
she'd give it to the township attorney for review.  That was yesteday.

At 10 AM today I received a call from her (the zoning officer) and she
said that she read the PRB-1 ruling and that she believed "I WAS RIGHT.
 THE ANTENNA COULD STAY UP.  SHE WOULD CALL THE COMPLAINANT AND TELL
THEM... IF THEY WANTED TO... TO TAKE THE MATTER UP WITH THE FCC."

I further told her that even without the PRB-1 ruling I was within the
letter of the ordinance because the ordinance specifies the my antennas
can be no higher than fifteen feet above the highest structure within a
500-ft radius. Now, that distance is at the very least a block.  Behind
my house other homes rise almost twenty feet in elevation since I sit
at the bottom of a hill.  I have the topo survey maps to prove it.
So I won on that issue too! Whoopie!!!!!

I also mentioned that since I'm a very reasonable person... (especially
since I won), that I would be very happy to discuss this calmly with
the complainant. The linear is warming up as I write!
