The patent office quit checking for that years ago. You can get a
patent for almost anything now, the thing doesn't have to even
work. The only thing it means is someone else just has to spend
the money later to overturn the patent.
If it's something worthwhile, that'll probably happen. If it's a small
low profit market, no one will bother.
