I think the important aspect here is that any such tower more than 200
feet AGL, or considerably lower in proximity to an airport will end up on
the aeronautical charts, so that flying aircraft have sufficient
information to avoid them.
Naturally, if the tower is close or tall enough to cause distruption to
an approach / departure path, it is conceivable such an installation
would be disallowed.
