It seems like I remember some one creating quite a hassle on one of the 
reflectors a few years ago about the fractal design with at least one 
(or more) participant being invited to leave.

The litigious part would account for the vacant web sites. However if I 
remember patent law correctly even if something is patented you can 
build yourself a copy under some conditions, although why any one would 
want to is beyond me.
