That is a good question for an attorney.  There are a lot of rent-a-qth and 
personally I do not see anything illegal about renting a home with a ham 
station.  I rented my Iguanavilla - Aruba  to visiting hams.

Isn't it against the rules to make money or receive reimbursement for the 
use of an Amateur Radio station?
