My opinion to this mess is that 3V8BB in this case did very wrong...
There is no such thing as stealing frequency, thats pure rubbish. The
station who is using a frequency first is the one that has the
priviledge to use it. If you are interested in transmission on that
frequency you first politely ask "is this frequency in use" or "QRL ?"
or "can i use this frequency". This is plain gentlemanship and this is
how we should behave on the radio. If someone starts "stealing" a
frequency from someone else that guy is a total nut. Did 3V8BB ask "is
this frequency in use"? NO !
Please read theese fine words already written in 1928:

interfere with any of the duties he owes to his home, his job, his scool
or his community.
The Amateur is Patriotic ... His knowledge and his station are always
ready for the service of his country and his community.
