I don't know what is or is not proprietary, but you can build anything 
you want including copying a commercial design as long as it's for your 
own amp.
Proprietary doesn't mean anything when it comes to building, nor does 
patenting.   OTOH the special interest groups have really been pushing 
against "fair use".
Proprietary normally means they didn't patent it and do not give out the 
circuit.  With today's "first to patent" rather than first to develop 
makes proprietary a very risky approach.
