That's not accurate.  The 'user' is responsible that all transmitted energy
is contained WITHIN the authorized band.  In the USA, the rule is:

  "§97.307 Emission standards.
    .
    .
    (b) Emissions resulting from modulation must be confined to 
         the band or segment available to the control operator.
