It wasn't the FCC, Congress did that. First line on the FCC OTARD page:
"As directed by Congress in Section 207 of the Telecommunications Act of
1996..."
47 CFR Section 1.4000 to be specific..
FCC just made regulations to implement the Congressional will.
Congress can most definitely make laws to prohibit restrictions, create
restrictions, or what-have-you.
