There is no Federal Uniform Construction Code.  Many States have a Uniform
Construction Code that varies from State to State and many States do not
have one specifically instead they regulate in other ways.

 

As others have said, its zoning and set back requirements in your local town
or city or county (depending on how your State governs such things) that
matter.

 

If you have a tall tower on a property and the local zoning or building
regulations have a "fall down" area as part of the tower permit, I would
think such dialog would come up at the subdivision hearing.  Its unlikely
that a subdivision of a lot would be allowed that would then make the
original non-compliant, unless a variance was issued as part of it.
