One of the problems here is that the various parts of the FCC don't talk to
each other! Made worse by the fact that Bill Luther who goes to the relevant
bits of ITU Study Group 1 and Bill Cross, who does the technical stuff on Part
97 in Washington, are both hams.
The ITU-R Recommendation SM329 on spurious emissions, which is incorporated by
reference into the Radio Regulations (which are considered as International
Law) actually requires spurious emissions from amateur stations operating below
30MHz to be -43 +10 log P dB down, but not exceeding 50dB down. The FCC, having
signed up to this, then managed to make a mess of incorporating the
requirements into Part 97. But the ITU recommendation refers to the harmonics
measured at the transmission line, so the attenuation of a tuner is quite
permissible.
In reality, a few sums can be done to show how far down the harmonics are if
you can't measure them.
