Well, lets not split hairs

The station in question was from a sought after DXCC entity (on 160m SSB 
anyway) and was working a pileup of stations calling him using my SDR, 
located ~ 4000Km closer to his callers (and connected to a reasonable 
beverage) than his transmitter
Effectively his callers are being defrauded out of a valid contact, they 
may have heard him directly but he did not hear his callers without the 
assistance of my receiver

Presumably his callers reasonably expect their QSO's to count for DXCC

  So I reiterate my opinion that in the

I think remote stations are a different matter entirely IF the 
transmitter AND receiver are located at the same location AND the 
call-sign used is a correct, Legal call-sign FOR the location where the 
transmitter is located
