Yes.. Legally.. He can have it... Obviously, it's an issue of an HOA, and not
a land use restriction.
Most HOA's have lawyers. I have a good friend who was recently sued by the
HOA for putting the wrong color roof on his home. (It was a cream colored
house, and he actually had the audacity to put a complimenting color roof
(Green) on the thing. They won their lawsuit, and then, foreclosed on the
property.
I'm surprised that this particular group didn't do something similar.
