i believe the rule that is usually quoted in cases like this is 97.101(a): "In
all respects not specifically covered by FCC Rules each amateur station must be
operated in accordance with good engineering and good amateur practice. "
and since all hams are supposed to 'get along' and our largest member
organization publishes a plan for sharing bandwidth it would be a good practice
to follow the recommended bandplan. this paragraph essentially gives the force
of a rule to all sorts of 'voluntary' agreements.
