If the other guy didn't get your confirmation (or he doesn't feel sure you
implicitly gave anything that serves as it) he took the risk.
If you didn't get confirmation and didn't give yours, or didn't feel the QSO
is completed, then this is not a QSO that has to be logged on your side.
Penalty is just there to avoid guessing and gambling, no matter why.
