What does it take to be disqualified for this? How many rules
violations does it take. Are the same people doing this every year?
every contest? multiple times in a contest?
Mistakes happen but are one offs not a patterned behavior.

The Canadian band plan published by RAC has a note that “During major weekend contests, activity in certain modes can spill over into other segments”. So in my opinion what you noted is a temporary violation in the heat of a contest. We can still avoid beacons and emergency frequencies.
