You or they can CALL it independent all they want.  But the President 
appoints ALL the members subject to the advice and consent of the Senate.
Congress has oversight on the FCC.... just like it has oversight on the 
REST of the Executive Branch.

There are ONLY THREE branches of government.  ALL governmental 
organizations under the Federal Government belong to ONE of those THREE 
branches.

The FCC is an Executive Function.
