Hi Ken,

The 36' is for hillside property (45' is for flat areas).
I told the planner that I was suprised about the CUP
because I had talked to people who had suggested
(as you are) that no CUP was necessary under the
height limits (45' for flat and 36' for hillside zones).
I hope it is really still the way you describe, but he
(the planner) said that the rules changed about 5
years ago and was pretty adament about his
position. He also said that a variance (as opposed
to a CUP) would be required for anything over the
height limit, but he made it sound like the application
process (neighbor notification, hearing, etc) was
exactly the same in both cases.

If this goes anything like the construction work
I did on my house over the summer, I fully expect
to get a completely different answer from every
city employee I pose the same question to :)


BTW, thanks for the offer on your casefile. I will
probably take you up on that at some point (I am
still debating about what kind of installation I am
going to ask for).
