The legal wording, the underlying regulatory requirement and the simple
practicalities all seem to allow the Licensee to be present at the
station itself, supervising the operation from there.
The exact wording, as quoted earlier by Colin, is (CAPITALS added):
"...provided that any such operatION of the Radio Equipment is carried
out IN THE PRESENCE OF and under the direct supervision of the
Licensee".
The wording is for the Licensee to supervise the operation, not the
operator. For regulatory purposes, all that Ofcom really needs is for
the station Licensee somehow to have direct personal supervision of the
outgoing transmissions. That can be done equally well from either end of
the link.
So it seems like there's plenty of scope for a sensible
interpretation... should Ofcom wish to do so.
