Seems to happen to weak stations only :)  I had one small freq fight
with a M/S station from OM who sat himself on my freq on 40m, but he
left after a few minutes when he reslised that he had no chance.

Sometimes I had someone just send "?" on my freq and start CQing about
half a second later, while I was listening for an exchange from
another station, but these CQers usually disappeared quietly directly
after I started CQing again or asked "NR AGN?" to the other station.

I personally also prefer NOT to send "QRL?" because that might invite
someone who is scanning the band to take the freq himself when he
hears no reply! When I hear an (possibly) empty freq that I'd like to
take, I first throw in a "?", when there is no immediate response, I
send my callsign twice, listen for a few seconds, then again throw in
my call. 
When there is no response until then, I assume the freq is free and I
start CQing.
