Well... as someone who has bought and sold a LOT of stuff (not just ham
radio gear) on the 'net, I think you have a point.

If I put something up for sale on an elist, I rank the buyer order by the
time on "I'll take it" email I receive back.  I then email the first buyer
(the one who got there first) with payment information along with notice
that if payment isn't received within seven days our deal is void and the
next person on the list gets a shot at the item.  I email the other buyers
that the item is TENTATIVELY sold but if the sale falls thru I will be
contacting them, in order... and I also provide the first three alternates
their relative 'pecking' order.

If the first buyer gets his money in on time, the unit is his, and I email
the other buyers that the item is sold.  I will usually give him an extra
day beyond the agreed-on limit, but contact the second buyer when the
deadline is up letting him know that he will PROBABLY be able to buy the
item.  And so on....

I think that if the seller sent you email and told you the item was yours,
and then invited you to send payment in... he had an ethically binding
agreement (although not legally binding).

After reading the correspondence you posted, I will also offer that the
Hercules II/253 tuner is a VERY desireable combo (and I don't understand why
Ten-Tec won't build 'em again... even if they did a limited edition run
they'd sell out quickly!), and perhaps the phone bidder upped the price
substantially or agreed to buy the rack also upon being told it was sold...
and the seller succumbed to temptation.    Based upon the message stream, I
agree with you that the seller should have sold the amp to you since you
were not negotiating anything at that point but just waiting for a final
purchase amount.
