W9AC nailed it.
I'm pretty sure the 15 dB limit applies to kits as well. Example,
Elecraft KPA500. A home brew amp does not have to stick to the 15dB limit.
As for SPE/Expert, they screwed up.
Why would the FCC grant a waiver to a company that 3 months, or however
long it was, prior started a petition for elimination of the requirement
altogether? That's just stupid and has nothing to do with Flex or any
other manufacturer. The fact that Flex commented on the stupidity is
irrelevant. The reason the waiver was denied is it's redundant and a
waste of time with a petition pending to do the same thing.
SPE/Expert got caught trying to use a federal agency for a competitive
advantage.

On all this legal stuff.
Ok a ready to use amp cant legally have more than 15 db of gain.
Now how far down broken down that is, does an amp have to be, to be
seen as a "KIT"
From what I in the back of my mind remember that a "KIT" does not have
to abide by that law?
Or am I thinking of something else?

A friend of mine, ex Telefunken design engineer, already built a

With 15W of drive output is 1200W.
Even without predistortion IMD3 is less then -30dB.
20 transistors will do your legal limit easily.

- A high efficiency, high gain, deliberately non-linear, legal-limit
final stage. This might take the shape of a simple overdriven broadband
class AB stage, or perhaps a class E stage with tuned, band-switched
output tanks. It might use a single BLF188XR for about $150, or several
small switchmode MOSFETs for far less money.
To these hardware ingredients I would add some freely available
software, such as Pavel Denim's software for the Red Pitaya, plus
PowerSDR, using closed-loop, RF-feedback amplitude and phase
predistortion to linearize the amplifier. The software has this already
implemented.
The result would be a legal-limit, high efficiency, high performance,
compact, black-box HF transceiver to be used with a PC, for under $1000
total cost, if you are good at ordering surplus power supplies on eBay,
and such.
