I have no doubt they would claim both frequencies are in use.  Emotionally,
I agree this is not right.   CQ have so far adopted a more literal/technical
stance regarding one transmitted signal at any one time.  This is what all
the discussion is about.  But ultimately CQ can apply/interpret the rules
governing their contests any way they please.
