They are not right. If they accept your payment for "insurance" that is 
an additional fee over the normal shipping liability they have. With 
insurance they are guaranteeing it will arrive safely.
Poor packaging is their responsibility to determine before they accept 
the package for shipment. What is the definition of "poor packaging"?

If they accept the package after you pay for insurance there should be 
no question as to how it was or wasn't packed when it comes time to pay 
up. Their insurance is a big rip off!
