That won't fly. It's the PROTOCOLS that need to be freely available.  
They need to be published and available to anyone who wants to  
implement.

Exactly. While proprietary protocols have no business on the amateur  
bands, proprietary IMPLEMENTATIONS are certainly welcomed.
