W9AC nailed it.

I'm pretty sure the 15 dB limit applies to kits as well. Example, Elecraft KPA500. A home brew amp does not have to stick to the 15dB limit.

As for SPE/Expert, they screwed up.

Why would the FCC grant a waiver to a company that 3 months, or however long it was, prior started a petition for elimination of the requirement altogether? That's just stupid and has nothing to do with Flex or any other manufacturer. The fact that Flex commented on the stupidity is irrelevant. The reason the waiver was denied is it's redundant and a waste of time with a petition pending to do the same thing.

SPE/Expert got caught trying to use a federal agency for a competitive advantage.
