No, SPE got caught out building amplifiers for the rest of the world
that do not meet the requirements for sale in the USA. Now, Expert Amplifiers wants the FCC to relieve them of the responsibility to see
that the amplifiers they import and sell in the US meet the legal
requirements.

Of course, SPE *could* design in additional negative feedback to use
up some of that extra gain *and* reduce the IMD created in their
dirty boxes.  The SPE 1.3K-FA has 3rd order IMD of only -27 dB at
*800W* per SPE's own test data filed with the FCC for type approval.

It's not the US government's constitutional role to pick winners
and losers. SPE got there first with an amp Hams want. The FCC
should get out of the way.

The existing amp gain reg. is silly and way overdue for termination.

IMHO, YMMV ...

SPE/Expert got caught trying to use a federal agency for a
competitive advantage.
